Terms of service.

Effective January 1, 2026. Read them — these are the terms under which we grant access to nutriasoft.

1. Acceptance

By creating an account or using nutriasoft you accept these terms in full. If you do not agree, do not use the service. Your account may be personal (single professional) or clinic-based (multiple users in one shared workspace).

2. Service description

nutriasoft is a SaaS platform for nutrition practices: digital clinical chart, scheduling, meal plans, patient portal, billing, reporting, and exports. We provide the service as is and as it evolves with each release.

We are not a healthcare provider. We do not issue diagnoses, we do not replace professional clinical judgment, and responsibility for patient care remains exclusively with the nutritionist who owns the account.

3. Accounts and eligibility

You must be 18 or older and a licensed nutrition professional (or authorized student) to open a nutritionist account. Patients may use the portal only when invited by their nutritionist.

You are responsible for the security of your password and all activity under your account. Notify us immediately if you suspect unauthorized access.

4. Acceptable use

You may not use nutriasoft to:

  • Violate applicable law, third-party rights, or people's privacy.
  • Upload malware, attempt to breach security, or reverse engineer the service.
  • Resell the service or share credentials outside the contracted workspace.
  • Store content unrelated to the professional practice of nutrition.

5. User content

You and your patients retain ownership of all uploaded content (charts, photos, plans, notes). You grant us a limited, non-exclusive license to host, process, and display that content solely to provide the service. That license ends when you cancel the account, except for technical backups deleted within 90 days.

6. Payments and subscription

Plans are billed in advance on monthly or annual cycles through Stripe. Prices are shown in Mexican pesos (MXN), with VAT included when applicable. Renewal is automatic unless canceled before the renewal date.

If payment fails we retry 3 times over 14 days. After that the account is suspended until payment is resolved — content is not deleted during that period.

7. Cancellation

You may cancel at any time through the Stripe portal or by writing to support. Access remains active until the end of the paid period. You may export your data before and up to 30 days after cancellation. After that period, data is deleted according to our retention policy.

8. Intellectual property

The software, brand, logos, and original content of nutriasoft are owned by Codemach (codemach.dev), under the representation of Miguel Ángel Careaga Gómez. We do not grant rights over the trademark or source code. The license we grant is limited to using the service under these terms.

9. Warranties

We work to keep the service available with a target monthly SLA of 99.5%. We do not guarantee uninterrupted availability. In the event of downtime longer than 4 continuous hours, we apply a proportional credit to your next invoice automatically.

10. Limitation of liability

To the maximum extent allowed by law, nutriasoft is not liable for indirect damages, lost profits, or data loss resulting from misuse, force majeure, or acts beyond our control. Our maximum aggregate liability is limited to the amount paid for the service in the 12 months before the event.

This limitation does not apply in cases of willful misconduct, gross negligence, or privacy violations attributable to us.

11. Governing law and jurisdiction

These terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the competent courts of Mexico City, waiving any other venue.
